Your use of the Nanit services is subject to this Acceptable Use Policy. If you are found to be in violation of our policies at any time, as determined by Nanit ("Nanit”, "we" or "us") in its sole discretion, we may warn you or suspend or terminate your account.

Please note that we may change our Acceptable Use Policy at any time, and pursuant to the Nanit Terms of Service (the "Terms"), it is your responsibility to keep up-to-date with and adhere to the policies posted here. All capitalized terms used herein have the meanings stated in the Terms, unless stated otherwise.

  1. You agree not to post, upload, publish, submit or transmit any Content that:

    1. violates, or encourages any conduct that would violate, any applicable law or regulation or would give rise to civil liability;

    2. is fraudulent, false, misleading or deceptive;

    3. impersonates or misrepresents your affiliation with any person or entity;

    4. is defamatory, obscene, pornographic, vulgar or offensive;

    5. promotes discrimination, bigotry, racism, hatred, harassment or harm against any individual or group;

    6. is violent or threatening or promotes violence or actions that are threatening to any person or entity;

    7. promotes illegal or harmful activities or substances;

    8. infringes, misappropriates or violates a third party’s patent, copyright, trademark, trade secret, moral rights or other intellectual property rights, or rights of publicity or privacy;

    9. violates any applicable law or regulation; or

    10. encourages or enables any other individual to do any of the foregoing.

  2. In general, Nanit will follow a graduated enforcement policy for repeated Acceptable Use Policy violations, though Nanit reserves the right at any time to take actions not consistent with this policy in circumstances that Nanit believes to warrant such action.

    1. First Violation: Nanit sends a written warning the user who violates the Acceptable Use Policy and Nanit may delete the applicable message(s).

    2. Second Violation: Nanit sends a written warning to the user who violates the Acceptable Use Policy and Nanit may delete the applicable message(s). In addition, Nanit will place the member's Account into moderation for 30 days.

    3. Third Violation: Nanit sends a written warning to the user who violates the Acceptable Use Policy and Nanit may delete the applicable message(s). In addition, Nanit will place the user’s Account into moderation for one year.

    The Content made available on or through the Services should not be relied upon when making medical or health decisions, or to diagnose or treat a medical or health condition. Any health-related content you may find in the Services is not intended to be used to diagnose, treat, cure or prevent conditions, as a medical guide or as a substitute for consulting with a pediatrician. For medical advice, you should consult a medical professional. YOUR USE OF THE SERVICES AND ANY INFORMATION PROVIDED IN CONNECTION WITH THE SERVICES IS AT YOUR OWN RISK.

  3. In addition to the Content restrictions above, you agree not to:

    1. use, display, mirror or frame the Services or any individual element within the Services, Nanit’s name, any Nanit trademark, logo or other proprietary information, or the layout and design of any page or form contained on a page, without Nanit’s express written consent;

    2. access, tamper with, or use non-public areas of the Services, Nanit’s computer systems, or the technical delivery systems of Nanit’s providers;

    3. attempt to probe, scan or test the vulnerability of any Nanit system or network or breach any security or authentication measures;

    4. avoid, bypass, remove, deactivate, impair, descramble or otherwise circumvent any technological measure implemented by Nanit or any of Nanit’s providers or any other third party (including another user) to protect the Services or Content;

    5. attempt to access or search the Services or Content or download Content from the Services through the use of any engine, software, tool, agent, device or mechanism (including spiders, robots, crawlers, data mining tools or the like) other than the software and/or search agents provided by Nanit or other generally available third-party web browsers;

    6. send any unsolicited or unauthorized advertising, promotional materials, email, junk mail, spam, chain letters or other form of solicitation;

    7. use any meta tags or other hidden text or metadata utilizing a Nanit trademark, logo URL or product name without Nanit’s express written consent;

    8. use the Services or Content, or any portion thereof, for any commercial purpose or for the benefit of any third party or in any manner not permitted by these Terms;

    9. forge any TCP/IP packet header or any part of the header information in any email or newsgroup posting, or in any way use the Services or Content to send altered, deceptive or false source-identifying information;

    10. attempt to decipher, decompile, disassemble or reverse engineer any of the software used to provide the Services or Content;

    11. interfere with, or attempt to interfere with, the access of any user, host or network, including, without limitation, sending a virus, overloading, flooding, spamming, or mail-bombing the Services;

    12. collect or store any personally identifiable information from the Services from other users of the Services without their express permission;

    13. violate any applicable law or regulation; or encourage or enable any other individual to do any of the foregoing.

  4. Although we’re not obligated to monitor access to or use of the Services or Content or to review or edit any Content, we have the right to do so for the purpose of operating the Services, to ensure compliance with these Terms and to comply with applicable law or other legal requirements. We reserve the right, but are not obligated, to remove or disable access to any Content, at any time and without notice, including, but not limited to, if we, at our sole discretion, consider any Content to be objectionable or in violation of these Terms. We have the right to investigate violations of these Terms or conduct that affects the Services. We may also consult and cooperate with law enforcement authorities to prosecute users who violate the law.
